These General Terms and Conditions of Purchase (hereinafter, the "General Conditions"), together, if applicable, with the particular conditions that may be established (hereinafter, the "Particular Conditions"), as well as any other document that both conditions are mentioned, are intended to expressly regulate the conditions governing the use of this Web Site and the purchase or acquisition of products and/or services on it.

In addition to reading these General Conditions and, where appropriate, the Special Conditions, before accessing, browsing and/or using this Website, the User must have read the Terms of Use of the Website, the Cookies Policy and the Privacy Policy. By using this Website or by making and/or requesting the acquisition of a product and/or service through it, the User agrees to be bound by the General Conditions and by all the above mentioned, so that, if he/she does not agree with all this, he/she should not use this Website, not being possible in such case the contracting of any product and/or services.

All purchases of products and/or services purchased through the Website shall be considered validly made by the User, and shall be binding. Consequently, the User shall be solely responsible for any purchases of products and/or services through the Website by a third party using his/her user name and password. The purchase of products/services on this Website by minors is not permitted. The placing of orders from the Web Site by a minor who falsifies registration information shall be understood to be made under the supervision and authorization of their parents, guardians or legal representatives.

4. WEBSITE ACCESS AND REGISTRATION

4.1. Requirements to register as a User.

The registered User assumes that his or her User account is personal and non-transferable, and both individuals and legal entities may register on the Website.

4.2. Unsubscribe as a registered user

The legal relationship derived from the registration as a User of the Website has an indefinite duration. Either party may terminate or suspend this contractual relationship unilaterally at any time and without any cause other than their will in this regard, without prejudice to the obligations arising from the formalization of orders prior to the termination of the relationship. The User may unilaterally exercise the right of termination through the account cancellation process.

In any case, once the User has been deregistered, he/she may request a new registration, with the exception of CERAMIC CONNECTION AIE's right not to assume said registration in case of conflict or controversy between the parties, which has not yet been resolved or which has ended with recognition of fault or negligence of the User and/or damage to CERAMIC CONNECTION, its collaborators and associates or to its users, clients or potential clients.

Therefore, the User should not only consider the information provided by the Website, but also the information available on the labeling, warnings and/or instructions accompanying the product.

CERAMIC CONNECTION AIE may, at any time, add new products and/or services on the Website, it being understood, unless otherwise provided, that such new products and/or services shall be governed by the provisions of the General Conditions in force at that time and, where appropriate, the Specific Conditions specific to that product and/or service. Likewise, CERAMIC CONNECTION AIE reserves the right to withdraw or cease to offer, at any time, and without prior notice, any of the products and/or services offered on the Website.

All purchase orders received by CERAMIC CONNECTION AIE through the Website are subject to the availability of the products/services and/or that no circumstance or force majeure (Disclaimer of Liability Clause of these General Conditions) affects the supply of the same and/or the provision of the services. In the event of difficulties in the supply of products or if there are no products in stock, CERAMIC CONNECTION AIE undertakes to contact the User and to reimburse, without undue delay, any amount that may have been paid by way of payment.

6. PURCHASE OR ACQUISITION PROCESS

The communications, purchase orders and payments involved during the transactions carried out on the Website could be filed and kept in the computerized records of CERAMIC CONNECTION AIE in order to constitute a means of proof of the transactions, in any case respecting the reasonable conditions of security and the laws and regulations in force that in this respect are applicable, and particularly in compliance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, on the protection of natural persons with regard to the processing of personal data of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter RGPD) and Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights, and the rights that assist Users in accordance with the Privacy Policy of this Website.

The different phases of the purchasing and/or contracting procedure are detailed below:

6.1. PHASE 1: Validation of the Shopping Cart.

The User, once the selection of the products and/or services he/she wishes to purchase has been completed, must validate his/her shopping cart, which will show the products and/or services selected, the number of units, the price of the same, the delivery time and the shipping costs. Similarly, you must select the delivery method: home delivery or in-store collection.

6.2. PHASE 2: Provide Billing and Shipping Data.

6.3. PHASE 3: Select the Payment Method.

The User, once he/she has provided the billing and, if applicable, shipping information, must select the payment method he/she wishes to use. Currently, CERAMIC CONNECTION accepts the payment methods indicated in section 7 of the present General Conditions (Economic conditions and payment methods).

6.4. PHASE 4: Payment of the total economic amount.

The User, once the payment method is selected, will be automatically redirected by the system to the online payment platform (TPV) of the corresponding banks.

6.5. PHASE 5: Confirmation of Purchase.

Subsequently, within 24 hours from the moment of the effective payment of the purchase by the User, the User will receive an email confirming that CERAMIC CONNECTION AIE has received his order or request for purchase and/or provision of the service, i.e. the confirmation of the order, together with a summary of all the characteristics of the purchase made. In any case, the customer will be able to consult and/or download this information through his personal private space of connection to the Website.

This e-mail will be considered "Proof of Purchase", and the User must keep it in safe custody.

Likewise, by accepting these General Terms and Conditions, the User agrees to receive the invoices derived from the purchase of products or contracting of services from CERAMIC CONNECTION AIE in electronic format. In any case, the client will be able to consult and/or download the invoice through his personal private space of connection to the Web Site.

However, in the event that the User wishes the invoice in physical format (on paper), he/she must send an e-mail to the address indicated in section 1 of these General Conditions (Identification of the person responsible for the website), requesting the invoice in physical format, duly identifying him/herself and indicating the order number for which the invoice in physical format is requested, as well as the postal address where he/she wishes the invoice to be sent in physical format.

7. ECONOMIC CONDITIONS AND METHODS OF PAYMENT

7.1. Economic conditions.

The prices displayed on the Web Site are final, are expressed in Euros (€) and include taxes, unless otherwise indicated and applied by law, especially with regard to VAT.

However, unless otherwise indicated, the prices of the items offered exclude shipping costs, which may be incurred, which will be added to the total amount due at the time of managing the shipping procedure by the User, and where the User will consult the shipping methods and costs available and freely choose the one that suits him/her best.

Under no circumstances will the Website automatically add additional costs to the price of a product or service, but only those that the User has voluntarily and freely selected and chosen.

CERAMIC CONNECTION AIE expressly reserves the right to modify the price of any of its products and/or services published on the Website, at any time and without prior notice. However, possible changes will not affect orders or purchases with respect to which the User has already formalized.

In the event that CERAMIC CONNECTION AIE identifies a manifest error in the price of any of the products and/or services published on the Website, it may immediately inform the Customer, as well as carry out the corresponding publication of the rectification of the same through the Website and in the usual means of communication, with the Customer having the option to reconfirm, through the personal and private section of the Website, his order at the correct price or, failing that, to cancel it.

7.2. Forms of Payment.

In order to proceed with the payment, the User must follow each and every one of the instructions shown in the section "Purchase or acquisition process", previously described.

All means of payment provided by CERAMIC CONNECTION AIE, are subject to checks and authorizations by the issuing entities of the means of payment (card issuers and / or issuers of payment accounts), but if such entity does not authorize the payment, you can not continue with the purchase procedure initiated, being automatically canceled the order, and understood not made the sale of the product / s and / or service / s requested. In such case, CERAMIC CONNECTION AIE will not be responsible for any delay or non-delivery and will not be able to formalize any contract with the User.

Similarly, the User can pay quickly and securely with his/her PayPal account, without sharing financial information with CERAMIC CONNECTION AIE. In case of selecting this payment method, the User will be redirected to the secure PayPal page, where he/she will have to enter his/her credentials and accept the payment. Once the payment is confirmed, the User will be returned to CERAMIC CONNECTION AIE's confirmation page, where he/she can confirm the status of the purchase.

The accepted means of payment will be:

In any case, by clicking on the AUTHORIZE PAYMENT, PAYMENT or similar button, the User confirms that the payment method used is his/her own.

8. PICK-UP AND DELIVERY CONDITIONS

The products and/or services whose purchase has been made through the Website may be picked up at the establishment, or may also be sent to the postal address indicated in the order form, which may not correspond to a post office box or public places, such as public roads, squares, stations, airports or other similar places.

8.1. Pick up at the establishment.

Once the order has been placed for collection at the establishment by the User, he/she may pick it up from 2 hours after receiving confirmation that the order is ready and prepared to be served, and always during business hours.

If you have indicated in the order that the products and/or services will be picked up at the collection point established by CERAMIC CONNECTION AIE, they must be picked up within a maximum period of seven (7) working days from the date of receipt of the confirmation that the order is ready and prepared to be served.

To proceed to pick up the products and/or services, the following steps must be followed:

-         If the User wishes to collect the products and/or services personally, he/she must go to the collection point established by CERAMIC CONNECTION AIE and identify him/herself with the original valid ID or Passport and show the Proof of Purchase, and collect the product(s) and/or service(s).

-         If you want the products and/or services to be picked up by a third party other than the User, the authorized person must show the Proof of Purchase together with an authorization to pick up signed and filled out by the User containing the complete data of the User and the person authorized to pick up (name, surname, ID or Passport number in force and address), the place, date and purpose of the authorization; and a photocopy of the User's valid ID or passport. It is essential that the authorized person identifies himself/herself by means of his/her original and valid ID card or passport.

8.2. Home delivery.

In cases where physical delivery of the contracted goods is required, deliveries shall be made within the international territory.

Except in those cases where there are unforeseen or extraordinary circumstances or, where appropriate, arising from the customization of the products, the purchase order consisting of the products listed in each purchase confirmation will be delivered within the period indicated on the Website according to the shipping method selected by the User and depending on the product selected.

If, for any reason, CERAMIC CONNECTION AIE is unable to meet the delivery date, it will contact the User to inform him/her of this circumstance and the User may choose to proceed with the purchase by setting a new delivery date or cancel the order with a full refund of the price paid. In any case, home deliveries are made on working days.

If it is impossible to deliver the order due to the User's absence, the order may be returned to the warehouse. However, the carrier will leave a notice explaining where the order is and how to get it delivered again.

If the User will not be at the place of delivery at the agreed time, he/she must contact CERAMIC CONNECTION AIE to arrange delivery on another day.

Any extraordinary expenses incurred as a result of changes and/or absences of the User at the place and time of delivery shall be borne by the User.

In the event that 30 days have elapsed since your order is available for delivery, and it has not been delivered for reasons not attributable to CERAMIC CONNECTION AIE, it will be understood that the User wishes to withdraw from the contract and the contract will be considered terminated. As a consequence of the termination of the contract, all payments received from the User will be refunded, except for the additional costs resulting from the User's own choice of a delivery method other than the least expensive ordinary delivery method offered by the Website, without any undue delay and, in any case, within a maximum period of 14 calendar days from the date on which the contract is deemed to be terminated.

However, the User must bear in mind that the transport derived from the resolution may have an additional cost that may be passed on to him/her.

For the purposes of these General Conditions, delivery shall be deemed to have occurred or the order shall be deemed to have been delivered at the time the User or a third party indicated by the User acquires material possession of the products, which shall be evidenced by the signature of the receipt of the order at the agreed delivery address.

The risks that may arise from the products shall be borne by the User from the moment of delivery. The User acquires ownership of the products when CERAMIC CONNECTION AIE receives full payment of all amounts due in connection with the purchase or acquisition made, including shipping costs, or at the time of delivery, if this takes place at a later time than the full receipt of the amount paid by CERAMIC CONNECTION AIE.

In accordance with the provisions of Law 37/1992 of 28 December 1992 on Value Added Tax (VAT), purchase orders for delivery and/or service shall be deemed to be located in the Spanish VAT territory if the delivery address is in Spanish territory except for the Canary Islands, Ceuta and Melilla*. The applicable VAT rate shall be that legally in force at any given time depending on the specific item in question.

In this regard, and in accordance with Chapter I of Law 37/1992, of December 28, 1992, on Value Added Tax (VAT) relating to the common VAT system, purchase orders shall be located, for delivery and/or performance, in that Member State of the European Union in which the address appearing on the purchase order is located and, therefore, the applicable VAT shall be that in force in that Member State.

*For technical reasons, we are unable to make sales or deliver orders to the Canary Islands, Ceuta and Melilla. We are sorry for the inconvenience

For the challenge of locations, other than the above, where the purchase orders will be located, for their delivery and/or provision, the regulations in force at each moment will be applied; the User must take into account that this could generate the application and accrual of taxes and customs duties at destination, in accordance with the regulations in force at destination, and that these could be borne by the User. For further information, the User should contact the customs office at destination.

8.3. Delivery Times

The usual delivery time is 6 working days for shipments in the peninsula. For shipments to the Balearic Islands it can be extended up to 10 days. For products that we do not have in stock, the delivery time can be extended up to 15 working days.

In case of any alteration in delivery times, you will be notified via e-mail.

It should be noted that during the month of August or during the Christmas period, deadlines may be extended.

9. TECHNICAL MEANS TO CORRECT ERRORS

The User is informed that in the event that he/she detects that an error has occurred when entering the data necessary to process his/her purchase request on the Website, he/she may modify them by contacting CERAMIC CONNECTION AIE through the contact spaces provided on the Website or using the information contained in the "Contact us" section

Likewise, this information may also be corrected by the User through his or her personal connection space on the Website.

In any case, before clicking on the corresponding button to confirm the order, make the purchase or confirm the payment, the User has access to the space, cart or basket where his purchase requests are recorded and can make modifications.

10. RIGHT OF WITHDRAWAL, RETURNS AND WARRANTIES.

In cases where the User purchases products on or through the Website of the owner, he/she has a number of rights, as listed and described below:

10.1. Right of Withdrawal

The User, as a consumer and user, makes a purchase on the Website and, therefore, has the right to withdraw from such purchase within 14 calendar days without justification.

This withdrawal period shall expire 14 calendar days after the day on which the User or a third party authorized by the User, other than the carrier, acquired the material possession of the goods purchased on the CERAMIC CONNECTION AIE Website or in case the goods composing his order are delivered separately, 14 calendar days from the day on which the User or a third party authorized by the User, other than the carrier, acquired the material possession of the last of those goods that make up the same purchase order, or in the case of a service contract, 14 calendar days from the day of the conclusion of the contract.

To exercise this right of withdrawal, the User must notify CERAMIC CONNECTION AIE]. You may do so, where appropriate, through the contact spaces provided on the Website or by using the information contained in the section "Contact us"

The User, regardless of the means he/she chooses to communicate his/her decision, must clearly and unequivocally express that it is his/her intention to withdraw from the purchase contract. In any case, the User may use the CERAMIC CONNECTION AIE withdrawal form model.

In order to comply with the withdrawal period, it is sufficient that the communication unequivocally expressing the decision to withdraw is sent before the expiry of the withdrawal period.

In case of withdrawal, CERAMIC CONNECTION AIE will reimburse the User all payments received, including shipping costs (with the exception of additional costs chosen by the User for a shipping method other than the least expensive method offered on the Website) without undue delay and, in any case, no later than 14 calendar days from the date on which CERAMIC CONNECTION AIE is informed of the decision to withdraw by the User.

CERAMIC CONNECTION AIE will reimburse the User using the same payment method used by the User to make the initial purchase transaction. This refund will not generate any additional cost to the User. However, [CERAMIC CONNECTION AIE may withhold such refund until it has received the products or items of the purchase, or until the User provides proof of their return, depending on which condition is met first.

The User may return or send the products to CERAMIC CONNECTION AIE at the address indicated during the return process.

And it shall do so without undue delay and in any event not later than 14 calendar days from the date on which CERAMIC CONNECTION AIE was informed of the withdrawal decision.

The User acknowledges knowing that he/she shall bear the direct cost of return (transport, delivery) of the goods, should any be incurred. In addition, he/she shall be liable for any diminished value of the products resulting from handling other than that necessary to establish the nature, characteristics and functioning of the goods.

The User acknowledges that there are exceptions to the right of withdrawal, as stated in Article 103 approving the revised text of the General Law for the Defense of Consumers and Users and other complementary laws. By way of example, and not exhaustive, this would be the case of:

-         The provision of services, once the service has been fully executed.

-         The supply of goods or services made to the Customer's specifications or clearly personalized.

-         The supply of sealed goods which are not suitable for return for reasons of health protection or hygiene and which have been unsealed after delivery.

-         The supply of sealed sound or video recordings or sealed computer programs that have been unsealed by the Customer after delivery.

-         The supply of digital content (which is not provided on a material medium) when the performance has already begun. The Customer expressly acknowledges that once the digital download has begun, the right of withdrawal shall be lost.

-         Any other good or service covered by art. 103 of RDL 1/2007, of November 16, 2007.

In any case, no refund will be made if the product has been used beyond the mere opening of the product, of products that are not in the same condition in which they were delivered or that have suffered any damage after delivery.

Likewise, the products must be returned using or including all their original packaging, instructions and other documents that may accompany them, as well as a copy of the purchase invoice.

10.2. Return of defective products or shipment error

In those cases in which the User considers that, at the time of delivery, the product does not conform to the stipulations of the contract or purchase order, he/she should contact CERAMIC CONNECTION AIE immediately and inform him/her of the existing non-conformity (defect/error) by email or by means of the contact form. The deadline to request the return is 14 calendar days after the customer receives or collects the goods. In the event that the products have suffered any damage or breakage during shipment, it should be noted at the time of receipt of the same, stating so on the delivery note of the carrier. It is recommended to check the goods received before any manipulation. In any case, no claims of any kind will be accepted after 14 calendar days.

For a correct processing of any claim, photos and/or videos of the problem in question will be necessary. If any damage or breakage has occurred during transport, it is advisable to take photos prior to any handling.

The User will then be informed on how to proceed with the return of the products and these, once returned, will be examined and the User will be informed, within a reasonable period of time, whether to proceed with the refund or, if applicable, the replacement of the same.

The amount paid for those products that are returned because of a defect, when it really exists, will be refunded in full. Whenever the return is motivated by a fault or error of CERAMIC CONNECTION AIE, the refund will include delivery charges and costs incurred by the User to make the return. The refund will be made by the same means of payment that the User used to pay for the purchase.

Reimbursement will be made only for products that have been returned to CERAMIC CONNECTION AIE's facilities in perfect condition, being the responsibility of the customer and his transport the integrity of the items.

Please make sure that the goods are perfectly packed and secured to ensure their integrity during transport. CERAMIC CONNECTION AIE will not be responsible for incidents during transport due to defective packaging.

In any case, the rights recognized in the legislation in force at any time for the User, as a consumer and user, will always be applicable

10.3. Warranties

The User, as a consumer and user, enjoys guarantees on the products that can be purchased through this Web Site, in the terms legally established for each type of product CERAMIC CONNECTION AIE responding therefore, for the lack of conformity of the same that is manifested within a period of two years from the delivery of the product.

In this sense, it is understood that the products are in conformity with the contract provided that: they conform to the description made by CERAMIC CONNECTION AIE and possess the qualities presented therein; they are suitable for the uses to which products of the same type are ordinarily intended; and they present the usual quality and performance of a product of the same type and which are fundamentally to be expected of the same. When this is not the case with respect to the products delivered to the User, the User must proceed as indicated in the section Return of defective products or error in shipment. However, some of the products that are marketed on the Website, could present non-homogeneous characteristics as long as these derive from the type of material with which they have been manufactured, and therefore will be part of the individual appearance of the product, and will not be a defect.

On the other hand, it could be the case that the User acquires on the Website a product of a brand or manufacture of a third party. In this case, and considering the User that it is a defective product, the User also has the possibility of contacting the brand or manufacturer responsible for the product to find out how to exercise its legal warranty rights directly against them during the two years following the delivery of such products. In order to do so, the User must have kept all the information regarding the warranty of the products.

11. DISCLAIMER OF LIABILITY

Unless otherwise provided by law, CERAMIC CONNECTION AIE accepts no liability for the following losses, regardless of their origin:

-         any losses that were not attributable to any default on its part

-         business losses (including loss of business profits, revenue, contracts, anticipated savings, data, goodwill or unnecessary expenses incurred); or

-         any other indirect loss that was not reasonably foreseeable by both parties at the time the contract of sale of products was concluded between them.

Likewise, CERAMIC CONNECTION AIE also limits its liability in the following cases:

-         CERAMIC CONNECTION AIE applies all measures concerning to provide a faithful visualization of the product on the Web Site, however, it is not responsible for the slightest differences or inaccuracies that may exist due to lack of screen resolution, or problems of the browser being used or others of this nature.

-         CERAMIC CONNECTION AIE will act with the maximum diligence in order to make available to the company in charge of the transport of the product object of the purchase order. However, CERAMIC CONNECTION AIE shall not be liable for damages resulting from a malfunction of the transport, especially for causes such as strikes, road delays, and in general, any other causes typical of the sector, resulting in delays, losses or thefts of the product.

Lack of availability of the Web Site for maintenance or other reasons, which prevents the availability of the service. At the same time, CERAMIC CONNECTION AIE will not be held responsible for an erroneous return made by the User. It is the responsibility of the User to return the correct product.

-         In general, CERAMIC CONNECTION AIE shall not be liable for any failure or delay in the performance of any of the obligations assumed, when due to events beyond its reasonable control, i.e. due to force majeure, and this could include, by way of example, but not exhaustive:

o   Strikes, lockouts and other industrial actions

o   Civil commotion, riot, invasion, terrorist threat or attack, war, (declared or undeclared) or threat or preparation for war.

o   Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster

o   Impossibility to use trains, ships, airplanes, motorized transport or other means of transportation, public or private.

o   Inability to use public or private telecommunications systems.

o   Acts, decrees, legislation, regulations or restrictions of any government or public authority.

In this way, the obligations will be suspended for the period during which the force majeure continues, and CERAMIC CONNECTION AIE will have an extension of time to perform them for a period of time equal to the duration of the force majeure. CERAMIC CONNECTION AIE will use all reasonable means to find a solution to enable it to perform its obligations despite the force majeure.

15. FULL AGREEMENT

These General Conditions and any document expressly referred to herein constitute the entire agreement existing between the User and CERAMIC CONNECTION AIE in relation to the object of the sale and purchase and supersede any other prior agreement, arrangement or promise agreed verbally or in writing by the same parties.

The User and CERAMIC CONNECTION AIE acknowledge that they have consented to the conclusion of a contract without having relied on any statement or promise made by the other party, except for what is expressly mentioned in these General Conditions.

16. WAIVER

No waiver by CERAMIC CONNECTION AIE of any specific legal right or action or CERAMIC CONNECTION AIE's failure to require strict performance by the User of any of its obligations shall constitute a waiver of any other right or action arising from a contract or the General Conditions, nor shall it exonerate the User from the performance of its obligations.

No waiver by CERAMIC CONNECTION AIE of any of these General Conditions or of any rights or remedies arising from a contract shall be effective unless it is expressly stated to be a waiver and is formalized and communicated to the User in writing.

17. FUERO

These General Conditions shall be governed by and construed, in all their terms and conditions, in accordance with current Spanish law.

CERAMIC CONNECTION AIE and the User expressly submit to the jurisdiction and competence of the Courts and Tribunals corresponding to the User's domicile or to those of the place of fulfillment of the contractual obligation for any questions or divergences that may arise due to the interpretation, fulfillment and execution of this contract.
